0. Age Requirement

This service is intended for users who are at least 16 years old. By using PrivateNote.ai, you confirm that you meet the minimum age requirement under applicable EU data protection laws.

1. Service Description & Encryption

PrivateNote.ai provides a tool for end-to-end encrypted, temporary data sharing. Client-side encrypted: Encryption occurs locally in your browser. We never receive your unencrypted data or your decryption keys.

Warning: If you lose the link or the password, the data is mathematically irrecoverable. Under no circumstances can we restore access to an encrypted note.

2. Data Protection (GDPR)

In accordance with the EU General Data Protection Regulation (GDPR), we minimize data collection. While note content is encrypted and anonymous to us, technical metadata (e.g., IP addresses) may be processed for security and rate-limiting purposes.

3. Prohibited Content & DSA

Pursuant to the EU Digital Services Act (DSA), you are prohibited from using this service to share illegal content, including but not limited to:

  • Child Sexual Abuse Material (CSAM)
  • Terrorist content or propaganda
  • Hate speech or illegal defamation
  • Unauthorized sharing of private data

We act as a neutral technical intermediary (“mere conduit”) within the meaning of applicable EU law. While we cannot monitor encrypted content, we will comply with valid legal orders from EU authorities to block access to specific resources.

4. Right of Withdrawal (EU Consumers)

By using our Service to create a Note, you expressly request the immediate performance of the service. You acknowledge that you lose your right of withdrawal once the digital content has been fully rendered or the Note has been created and shared.

Paid subscriptions: if you are a consumer in the EU or EEA, you have 14 days from the start of a paid subscription to withdraw from it. Because you ask us at checkout to start the service immediately, if you withdraw within those 14 days we refund what you paid less an amount in proportion to the service already supplied up to the moment you tell us. Write to support@privatenote.ai to withdraw. This right is separate from the ordinary cancellation described in section 5, which stops the next renewal without a refund.

5. Paid Plans, Billing & Cancellation

PrivateNote.ai is free to use. Starter and Business are optional paid plans that add delivery controls, higher limits and — on Business — branding on the reveal page. Payments are handled by Stripe; we never see or store your card details.

  • Billing in advance: paid plans are charged when you subscribe and then at the start of each renewal period, monthly or annually as you choose. Prices are shown in USD or EUR based on your region, and the exact total appears at Stripe Checkout before you pay.
  • Automatic renewal: your subscription renews automatically at the price then in force until you cancel it.
  • Cancelling: cancel at any time from Account → Manage billing. Cancellation takes effect at the end of the period you have already paid for. You keep your paid features until then, and that period is not refunded.
  • Upgrading: an upgrade starts immediately. Stripe charges the difference for the rest of the current period and credits the unused part of your previous plan. Your renewal date does not change.
  • Downgrading: a downgrade takes effect at the end of the current period, so you keep the higher plan until then.
  • Failed payments: if a renewal payment fails we email you and keep your paid features for a grace period of at least three days while the payment is retried. If it still fails, the account returns to Free. Notes you already created keep the conditions under which they were created.
  • Deleting your account: deleting your account also cancels your subscription. Time left in the period you have paid for is not refunded.
  • Price changes: we may change prices. Any change applies from your next renewal, and we will tell you by email before it takes effect.

Taxes: the total shown at Stripe Checkout is the amount charged. We do not currently add VAT. The seller is Marjan Skrobot, an independent (indépendant) in Luxembourg, applying the small-enterprise VAT franchise scheme (régime de franchise) under Article 57bis of the amended law of 12 February 1979. Your invoice states this. If tax becomes chargeable in future, prices shown to consumers will include it.

6. Service Availability

We strive to keep PrivateNote.ai available at all times, but the service is provided on an “as is” and “as available” basis.

We reserve the right to modify, suspend, or discontinue parts of the service at any time for security, legal, or operational reasons.

7. AI Features

Optional AI-powered features are provided for convenience only. Any output generated by AI does not constitute legal, medical, or professional advice.

You remain solely responsible for the content you submit to AI features and for how you use any generated output.

8. Liability Limits

Under Luxembourg law, we are liable for damages resulting from gross negligence or willful misconduct.

However, to the extent permitted by law, PrivateNote.ai is not liable for any indirect losses, loss of data caused by user error, or unauthorized access to your devices. We do not guarantee 100% uptime.

9. Governing Law & Jurisdiction

These terms are governed by the laws of the Grand Duchy of Luxembourg. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Luxembourg City.
